1. About these terms
These terms apply when you create an account, place an order or use a Frags4u game-server hosting service. They form a contract between you and Wayne Fazackerley trading as Frags4u. The product description, configuration, price and paid rental period shown during checkout form part of that contract.
You must be at least 18 years old and legally able to enter a contract. Services are currently offered to customers in the United Kingdom. Nothing in these terms limits rights that cannot lawfully be limited, including your rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.
2. Accounts and security
You must provide accurate information, keep it current and protect your password and authentication details. You are responsible for activity performed through your account unless caused by our failure to use reasonable care. Tell us promptly if you suspect unauthorised access. We will never ask you to disclose your password by email.
3. Orders and provisioning
An order is accepted when we confirm successful payment. We then begin automated provisioning at your express request. “Ready in Minutes” describes our normal objective, not a guaranteed deployment time. Installation time can vary because of game publisher systems, download size, platform maintenance, capacity, security checks or other technical conditions. Your dashboard will show the current state.
If we cannot provide the ordered service within a reasonable time, contact Support. We may offer a correction, replacement, service credit or refund as appropriate to the circumstances and your legal rights.
4. Service configuration
Your plan includes the resources and features displayed at checkout, such as RAM, storage, slots, backups and rental period. A “slot” is a configuration or licensing limit and does not promise that the allocated resources will sustain that number of simultaneous players under every mod, map or workload. You are responsible for selecting suitable settings and maintaining compatible customer-installed content.
5. Payments, renewals and taxes
Prices and the total payable are displayed before payment. Subscriptions renew automatically for the selected rental period using the payment method held by our payment provider unless cancellation has been scheduled. Longer terms are charged in advance and renew for the same term. We may change future renewal prices by giving reasonable advance notice; a change does not alter a period already paid.
Payments may be processed by Stripe. Where Stripe or another provider acts as merchant of record, its checkout terms may also apply and it is responsible for the indirect taxes identified at checkout. Otherwise, Frags4u remains the supplier and charges taxes where legally required.
6. Cancellation and statutory rights
You may schedule ordinary subscription cancellation through the Billing Portal. The service remains available until the end of the current paid period and will not renew. Details of the statutory 14-day cancellation right, immediate service requests and refunds are in our Refund and Cancellation Policy, which forms part of these terms.
7. Acceptable use
You must not use the service to break the law; infringe intellectual-property, privacy or other rights; distribute malware; conduct denial-of-service attacks, unauthorised scanning, intrusion, fraud, spam or cryptocurrency mining; evade platform limits; interfere with other customers or infrastructure; host unlawful or abusive material; or breach applicable game publisher or platform rules. You must not resell the service unless we have agreed this in writing.
We may investigate abuse, preserve relevant evidence, restrict network traffic, suspend a service or remove unlawful or dangerous material where reasonably necessary. In urgent cases we may act without advance notice. Where appropriate, we will explain the reason and give you an opportunity to remedy it.
8. Game software, mods and customer content
Game software, trademarks and third-party content belong to their respective owners and are subject to their licences. You are responsible for ensuring that uploaded mods, plugins, worlds and other content are lawful and appropriately licensed. You retain ownership of your content and grant us a limited licence to store, copy, transmit and process it only as needed to provide, secure, back up and support the service.
9. Backups and data
Backup availability and retention depend on the purchased plan. Backups reduce risk but are not guaranteed to capture every change or recover from every failure. You should retain independent copies of irreplaceable worlds, configurations and content. We may delete service data after the service ends, following the retention periods described in the Privacy Policy and operational notices.
10. Availability, maintenance and changes
We provide the service with reasonable care and skill. Unless a written service-level commitment says otherwise, continuous or uninterrupted availability is not guaranteed. We may perform maintenance, apply security fixes, change network routes, move workloads or update software. We will seek to minimise disruption and provide notice for planned material maintenance where reasonably practicable.
11. Suspension and termination
We may suspend or terminate a service for non-payment, serious or repeated breach, security risk, unlawful activity, risk to other users or infrastructure, or where required by law. Except in urgent or serious cases, we will normally provide notice and a reasonable opportunity to remedy the issue. You remain liable for charges properly incurred before termination.
12. Liability
We are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for customer-controlled software or configuration, or for failures of third-party game platforms outside our reasonable control. If you use a consumer service for commercial purposes, we are not liable for business losses such as lost profit, revenue, opportunity or goodwill.
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded.
13. Events outside reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, including major network failures, upstream platform outages, attacks, power failure, natural disaster, industrial action or legal restrictions. We will take reasonable steps to reduce the effect and restore service.
14. Changes to these terms
We may update these terms for legal, security, operational or service changes. Material changes affecting an existing subscription will be notified in a durable form before they take effect. The version accepted with an order remains recorded with that order where required.
15. Complaints and disputes
Please raise a ticket at support.frags4u.co.uk. We will try to resolve complaints fairly and promptly. These terms are governed by the law of England and Wales. If you are a consumer, you may bring proceedings in the courts applicable to your UK residence as permitted by law.
